1. Terms of Service (ToS)
By creating an account, purchasing the "Founder Pass", or using the Vizion platform, you agree to be bound by these Terms. If you do not agree, you must explicitly discontinue the use of our services.
1.1. The "Founder Pass" & Lifetime Deal (LTD) Definitions
We offer a "Lifetime Deal" (LTD) structure for early adopters. To ensure clarity and prevent future disputes, the following definitions apply strictly:
"Lifetime" Definition: The term "Lifetime" refers exclusively to the lifetime of the product (Vizion), not the lifetime of the buyer or the developer.
If Vizion is acquired, these accounts will be honored by the acquirer to the best of our ability.
If Vizion ceases operations due to bankruptcy, technical obsolescence, or business closure, the "Lifetime" access terminates immediately without further compensation.
"Founder Plan" Scope: The LTD grants access to all features currently mapped to the "Founder Plan". We reserve the right to introduce new, separate "Add-on" features in the future (e.g., Enterprise SSO, On-Premise Hosting, or third-party premium integrations) that are not included in this pass.
Non-Transferability: Your license is tied to your personal or business account. It may not be resold, leased, or transferred to a third party without the express written permission of Vizion.
1.2. Fair Use Policy (FUP) – AI & Transcription
While Vizion provides "Unlimited" access to platform features (Video Rooms, Canvas, Notes), the generative AI and Transcription services rely on third-party costs (e.g., OpenAI, Deepgram). To ensure the sustainability of the Lifetime Deal, a Fair Use Policy applies:
Monthly Allowance: Each "Founder Pass" account is allocated 1,200 minutes (20 hours) of AI Transcription and Processing time per calendar month.
Reset Cycle: This allowance resets automatically on the 1st day of each month. Unused minutes do not roll over to the next month.
Overage & Abuse:
If you exceed the 20-hour limit, AI transcription features will be temporarily paused until the next cycle. You may continue to use unlimited Video Recording and Canvas features without AI processing.
We monitor for automated/bot usage. Accounts showing patterns of abuse (e.g., continuous 24/7 recording, reselling API access) may be suspended or terminated without refund.
1.3. Beta Software & "As Is" Disclaimer
Vizion is currently in Public Beta. By purchasing, you acknowledge that:
The Service is provided "as is" and "as available" without warranties of any kind.
Bugs, downtime, and data inconsistencies may occur.
Limitation of Liability: To the maximum extent permitted by Belgian law, Vizion shall not be liable for any indirect, incidental, or consequential damages (including loss of data, profits, or business interruptions) arising from the use of the Service. You are responsible for maintaining backups of critical strategic documents.
1.4. AI Disclaimer (Vizy)
Our AI assistant, "Vizy," utilizes Large Language Models (LLMs) to generate summaries and code.
Accuracy: AI can produce "hallucinations" or incorrect information. You agree to verify all code snippets, summaries, and facts before using them in a production environment.
Data Privacy: We do not use your private workspace data (notes, recordings, code) to train our public models. Your data remains isolated within your instance for your exclusive use.
1.5. Refund Policy
We stand behind our product with a guarantee that exceeds statutory requirements:

1.6. Governing Law & Jurisdiction
These Terms are governed by the laws of Belgium.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of the judicial district of Charleroi (Hainaut), Belgium.
For US-based customers: You agree to resolve any disputes through individual arbitration or small claims court in Belgium, and you waive the right to participate in class action lawsuits.
2. Privacy Policy (GDPR & CCPA Compliant)
Vizion is committed to protecting your personal data. We comply with the General Data Protection Regulation (GDPR) (EU) 2016/679 and respect the principles of the California Consumer Privacy Act (CCPA).

2.2. Data We Collect
We collect only the data necessary to provide the Service:
Identity Data: Name, email address (for authentication and billing).
Financial Data: Payment history (Note: Full credit card details are processed and stored securely by Stripe; we do not store them on our servers).
Content Data: User-generated content including diagrams, text notes, audio/video recordings, and uploaded files on the Canvas.
Usage Data: Anonymized logs and analytics (e.g., session duration, feature usage) to improve UX and platform stability.
2.3. Legal Basis for Processing
We process your data under the following grounds:
Contractual Necessity: To deliver the Vizion service, manage your account, and handle billing.
Legitimate Interest: To debug technical issues, detect fraud, and improve platform performance.
Consent: For marketing communications (newsletters), which you can opt-out of at any time.
2.4. Third-Party Sub-processors

2.5. International Transfers
For users outside the EU: Your data is processed in Belgium (EU). Transfers to US-based sub-processors (like OpenAI) are protected by Standard Contractual Clauses (SCCs) and Data Processing Agreements (DPAs) ensuring GDPR-level protection.
2.6. Your Rights (User Control)
Under GDPR and CCPA, you have the right to:
Access: Request a copy of all personal data we hold about you.
Rectification: Correct any inaccurate or incomplete data.
Erasure ("Right to be Forgotten"): Request the permanent deletion of your account and all associated data.
Portability: Receive your data in a structured, commonly used format (JSON/CSV) to transfer to another provider.
